Terms and Conditions for the Purchase of Digital Products

1. General Provisions

1.1. These terms and conditions outline the rules for purchasing digital products in the online store Michał Cholka. 1.2. The store is operated by Michał Cholka, with its registered office at B. Krzywoustego 13/1, 78-100 Kołobrzeg, Poland, NIP 671 183 56 30.

2. Purchase of Digital Products

2.1. Digital products include music files in formats [e.g., MP3, FLAC] available for download after purchase.

2.2. To purchase a digital product, the customer must: a. Select the desired digital product. b. Add the product to the shopping cart. c. Proceed to checkout and make the payment. d. Agree to the immediate commencement of the service and acknowledge the loss of the right to withdraw from the contract by checking the appropriate box during the purchase process.

3. No Right to Withdraw from the Contract

3.1. According to Article 38, point 13 of the Consumer Rights Act of May 30, 2014, the right to withdraw from a distance contract does not apply to contracts for the supply of digital content that is not supplied on a physical medium, if the performance of the service has started with the consumer's explicit consent before the withdrawal period expires and after informing the consumer about the loss of the right to withdraw from the contract. 3.2. When purchasing digital products from the Michał Cholka store, the consumer is required to consent to the immediate commencement of the service and acknowledge the loss of the right to withdraw from the contract.

4. Complaints

4.1. In the case of issues with downloading the digital product or its damage, the consumer has the right to file a complaint. 4.2. Complaints should be submitted via email to: holk.mh@gmail.com or in writing to the address: B. Krzywoustego 13/1, 78-100 Kołobrzeg. 4.3. The complaint should include the consumer's contact details, a detailed description of the issue, and the consumer's request. 4.4. Michał Cholka will review the complaint within 14 days from its receipt and will inform the consumer about the resolution. 4.5. Complaints regarding the inability to download the digital product or errors in the files will be resolved by allowing the consumer to download the product again or providing a new file.

5. Liability

5.1. Michał Cholka is not responsible for issues with downloading digital products arising from:a. Malfunctions of the consumer's devices.b. Technical problems beyond Michał Cholka's control (e.g., internet connection issues).

5.2. The consumer is responsible for ensuring that their device meets the technical requirements necessary to download and play the digital product.

7. Final Provisions
